1. Acceptance of Terms

By accessing or using Marka ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Marka is a peer-evaluation web application for teachers. The Service lets educators build rubrics, run evaluation periods, collect anonymized peer feedback from students, and generate aggregated results and reports.

3. Basic Plan

New accounts start on the Basic plan, which is free with no time limit: unlimited classes, rosters, rubrics, evaluation periods, results, reports, and CSV export.

  • No credit card is required to create an account or use Basic.
  • Your data is not deleted for staying on Basic indefinitely.

4. Insights Add-on

Insights is an optional add-on offering AI-assisted note screening and summaries on top of Basic.

  • Insights is currently activated by an administrator upon request.
  • Request upgrade instructions from the app's Pricing page; the account email used is either your signed-in account's email or one you provide.
  • Insights pricing and activation terms are communicated directly at the time of your request, not published here, since terms may vary.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Use the Service to store data about individuals without appropriate consent or authority to do so.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Interfere with or disrupt the integrity of the Service or its data, including attempting to bypass tenant data isolation.
  • Use automated scripts to access the Service in ways that exceed normal usage.

6. Data Ownership

You retain full ownership of all data you input into the Service, including student roster information, rubrics, and evaluation records. We do not claim any rights to your data. See our Privacy Policy for details on how data is handled.

7. Students

Students authenticate using a per-student access code that a teacher generates and hands out; students do not create their own accounts and never receive email from the Service. You are responsible for ensuring that collecting and evaluating student data complies with applicable laws and your school's policies.

8. No Warranty

The Service is provided "as is" without warranty of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of bugs. Use the Service at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Termination

You may stop using the Service at any time. You can delete your account in the app or submit a public account-deletion request. We reserve the right to suspend or terminate accounts that violate these Terms.
